Document Description

A 30 Day Notice is required (unless otherwise specified in the lease) before initiating eviction proceedings to terminate a tenancy for a violation of a lease agreement for tenants who pay monthly.

Who: Unless the lease states otherwise, give this notice to a tenant who pays rent monthly and has violated the lease agreement.

What: The Notice to Quit warns the tenant to cure the default (when applicable) in 14 days or vacate within 30 days OR face eviction.

When: This notice is given to a tenant at least 30 days prior to filing for eviction provided the tenant has not cured the default within 14 days.

Important: If substantially the same act or omission which constituted a prior noncompliance of which notice was given, recurs within 6 months, the landlord may terminate the rental agreement upon at least 14 days written notice specifying the breach and the date of termination of the rental agreement; without the giving opportunity to pay.
